Terms of business
These terms of business govern the use of the MyTripFleet driver portal and the provision of transfer services in Prague and the surrounding area. They apply to every provider and driver working for MyTripFleet. By accepting a job in the driver portal, a driver confirms that they have read these terms and agree to them in full. The binding version is the Czech one. This is a translation.
1. The operator
The service is operated by Daniel Grey, company number (IČO) 87262304, VAT number (DIČ) CZ8606141819, a self-employed natural person trading under the MyTripFleet brand (the “operator”).
MyTripFleet is a partner of MYTRIPLINE s.r.o., company number 07388489, registered at Roháčova 145/14, 130 00 Prague 3, for Prague and the surrounding area. Bookings arrive from them and part of the record of how a job went is passed back to them.
Contact for legal and data-protection matters: [email protected]. The operator may in future be transformed into a limited company. Until then, the operator and data controller is the natural person named above.
2. Definitions
- Driver portal: the MyTripFleet web application for taking and running jobs and for tracking documents, penalties, bonuses and payouts.
- Job (ride): a transfer ordered through Mytripline or MyTripFleet.
- Driver (provider): a self-employed person or company performing jobs in their own vehicle.
- No-show: the client does not arrive at the pickup point within the stated waiting time.
- Buffer Time: 30 minutes on airport transfers, counted from the flight's actual landing.
- Cancellation penalty: the contractual penalty for cancelling an accepted job without grounds.
3. Starting the cooperation and access to the driver portal
An applicant applies through the registration form on the MyTripFleet website. An application is not a contract, the operator reviews it and, if approved, creates the driver an account in the driver portal and tells them by e-mail.
The driver must upload the documents the operator requires. About themselves: two identity documents (one of them the driving licence), a profile photograph and a criminal-record extract.
About the car: the registration certificate, a photo of the inspection sticker, the green card, four photographs of the exterior, one each: front, rear, left side and right side, in daylight and with the plate readable in every one of them (for the side shots, photograph from the corner of the car) and three photographs of the interior, again one each: the front seats, the rear seats and the luggage compartment. The interior must be clean and tidy in those photographs, free of litter and personal belongings. The car is entered in the driver portal, colour included. Without complete paperwork it cannot be filed with the supplier, and so cannot be driven for us.
Vehicle paperwork is uploaded to the driver portal and nowhere else.
The vehicle must be approved by the operator. A vehicle older than twelve years is not accepted. The driver is responsible for the documents they upload being valid and must update them without undue delay when they change.
The operator reserves the right to refuse an application or to end access to the driver portal, and is not obliged to give a reason.
4. Taking and assigning jobs
Drivers choose jobs themselves from the free jobs offered in the driver portal, by pressing the button that assigns the job to them. Dispatch may also assign a particular job directly.
Once a driver accepts a job, they are taken to be driving it and bear full responsibility for performing it.
The driver portal will not let a driver take a job that overlaps another of theirs, or one for which they have no approved vehicle with enough seats. Working around that limit by arrangement outside the portal is not permitted.
If a driver needs to cancel an assigned job for any reason, they must contact dispatch immediately. Cancelling it on their own is not possible.
5. Cancellation penalty for an accepted job
If a driver cancels an accepted job without proper grounds and/or without contacting dispatch in advance and in good time, they must pay a cancellation penalty of 100 % of the price of that job. Example: a job priced at €13 means a €13 penalty.
The penalty does not apply where the driver contacted dispatch in good time and demonstrably, gave an objective and serious reason (illness, an accident, a vehicle fault and the like), and dispatch approved the cancellation.
Cancellation penalties are recorded in the driver portal, are visible to the driver, and are deducted from future payouts. Where there is nothing to deduct from, the driver pays them separately.
6. Mandatory use of the driver portal and the statuses
Throughout a job the driver must use the MyTripFleet driver portal and update the statuses in real time. The portal records the vehicle's position. That record is the binding evidence of how the job went and of whether a no-show is recognised.
The statuses that must always be pressed:
- Setting off: on ordinary jobs at least 1 hour before the scheduled pickup time. On long-distance jobs only when the driver gets into the car and actually sets off.
- I am here: immediately on actually arriving at the pickup point.
- Client on board: once the client is in the car and the ride has begun.
- Finish the ride: after dropping the client off and closing the job.
Without these statuses and the position record a job cannot be treated as properly performed. Sharing position is therefore a condition of performing a job. Its scope and purpose are described in the privacy policy.
On any problem: a delay, a change of place, an unreachable client, a vehicle fault, the driver must inform dispatch at once.
7. Waiting times
Airports (with Buffer Time): the driver may arrive at the pickup point no earlier than 30 minutes after the flight actually lands. The standard 60-minute waiting time starts from that moment. The total is therefore not 90 minutes.
Hotels and other places: the waiting time is 15 minutes from the “I am here” status.
8. Contacting the client, and what to do on a no-show
On airport jobs the driver may contact the client 24 hours in advance (WhatsApp, SMS or a call) asking them to switch their phone on after landing and to say when they have their luggage and when they are through passport control. On that basis the driver reaches the terminal within 10 minutes of the client's last message. A driver in contact with the client need not stand at the terminal. The “I am here” status is given on actually arriving.
If the client answers neither messages nor calls, the standard procedure applies: 30 minutes of Buffer Time and 60 minutes of waiting. With every condition met, the job is paid in full.
If the client has not arrived once the waiting time is up, the driver takes and immediately sends to the “No-show (client did not arrive)” channel:
- A photo with GPS coordinates on arrival at the place.
- A photo with GPS coordinates on leaving the place.
- A screenshot of the call history showing every attempt to make contact.
- A screenshot of the messages (WhatsApp, SMS or chat with the client).
The driver then marks the No-show status in the driver portal. Without the GPS photographs, the call screenshot and the message screenshot, a no-show will not be recognised and the job will not be paid.
9. Payment, invoicing and payout dates
The driver knows what a job pays before taking it, the driver portal states, on every offer, the amount the driver will receive. The difference between the price of the job and the driver's share is the operator's commission.
Payouts are calculated per calendar month driven. Invoicing for jobs driven in a given month takes place during the following month. Payment is made no later than the 15th day of the second month after the month driven, roughly within 45 days of the end of that month.
A driver may request a partial payment (an advance) through the driver portal. The operator is under no obligation to grant it. The decision rests with dispatch. Requests for payment, whether regular or partial, are made through the driver portal only.
Payment is made by bank transfer to the account the driver gives, or in cash by arrangement. The driver is responsible for the accuracy of the details they give for payment and for their own tax and social-security obligations. The operator is not their employer.
10. Penalties and bonuses
All contractual penalties, cancellation penalties included, are recorded in the driver portal and are visible to the driver. A driver may raise a recorded penalty with dispatch.
Bonuses may also be awarded in the driver portal, for driving exceptional or demanding jobs, helping dispatch out, high reliability, positive client feedback, or other work above the ordinary.
Both bonuses and penalties are taken into account in the payout for the period concerned.
A separate rule applies to a vehicle the driver shares with another driver or which the operator has provided. The driver must hand such a vehicle over with enough fuel for the next driver to cover at least 100 km without refuelling, or with a corresponding state of charge in the case of an electric vehicle, and hand it over clean, free of personal belongings, with the documents and keys in the agreed place. A breach of this obligation is grounds for a contractual penalty under this article.
11. Liability
The driver is responsible for complying with these terms, with traffic law and with the rules governing their business, for the roadworthiness and insurance of the vehicle, and for the safety of the people they carry.
The driver must hold valid motor third-party liability insurance and every authorisation needed to carry passengers for the whole of the cooperation.
The operator is not liable for damage caused by a driver breaching their obligations. Nor is the operator liable for damage arising from the driver portal being unavailable for reasons outside its control. In that case the driver follows dispatch's instructions.
12. Personal data
The scope, purposes and retention of personal data of drivers and passengers are described in the privacy policy on this website. A driver must use passenger data learned in connection with a job solely to perform it, and must not share it with anyone else.
13. Ending the cooperation
Either side may end the cooperation. The operator may end access to the driver portal immediately on a breach of these terms, in particular not using the portal, a false no-show, cancelling an accepted job without grounds, or refusing an assigned job without dispatch's agreement.
Ending the cooperation does not extinguish rights and obligations that arose before it, in particular the right to payment for jobs driven and the obligation to pay recorded penalties.
14. Changes to these terms
The operator reserves the right to change these terms unilaterally. The current version is always available in the driver portal and at mytripfleet.com. Drivers will be told of a material change by e-mail or by a notice in the driver portal and will be asked to agree again. Until they do, no new jobs can be taken.
15. Final provisions
These terms are governed by the law of the Czech Republic. Disputes arising from them are decided by the courts of the Czech Republic.
If any provision of these terms is invalid or ineffective, the validity of the remaining provisions is unaffected.
